The Community Corrections Regional Administrator can deny Home Confinement for the following:

  • Any Public Safety Factor (Sex Offender Violence etc)
  • Separation cases
  • Public Concern
  • History of Escape
  • Prior Community Corrections Failure
  • Unlikely to be employed
  • Elderly (different program)
  • Unable to work (separate program)
  • In a position where the BOP would have to pay for medical expenses, so if you are not medically able, you will not get home confinement.

The other method is being elderly and going through FSA Reduction of Sentence for the Elderly.
